I,the signatory of this quotation agree that the product may be removed from the site in the event of payment default, after FG Smart Solutions has obtained the necessary court order permitting them to repossess such goods FG Smart Solutions requires a deposit of 70% to confirm the order. We may impose a cancellation fee in the event of cancellation before delivery. The fee will depend on the nature of the order, the length of notice of cancellation before delivery, the reasonable potential to find alternative clients for the order and the reason for cancellation. No refunds on deposits in the event of cancellation for already ordered/made Special-Order Goods. The company will not be held responsible for any hidden or unknown factors which cannot be determined when visiting the site i.e. hidden cables, pipes, inferior support beams, foundations, or any other inferior structural items, unless the determination of such hidden factors are within the Company’s reasonable control. The system should be the last component installed on site, however should the client insist on pre-installation of track/s and glass, any damage incurred by other parties shall be for the client’s/responsible person’s account, unless such damage having been incurred are within the Company’s reasonable control. According to our calculations the light block out of the FG02 Shutter is 90%.
Refund Policy:
Please choose carefully. FG Smart Solutions does not normally give refunds if you simply change your mind or make the wrong decision. You can choose between a refund, exchange or repair, where goods as defective within the warranty period or within 10 business days if the products are wrongly described, different from the sample shown to you or do not perform. If the products are correctly installed or affixed, we will not accept a return or amendment of the product, unless defective. We may charge a handling fee if the return is accepted by management.
Delivery:
Notwithstanding anything to the contrary FG Smart Solutions obligation to deliver goods shall in all cases be subject to the following:
Whilst delivery times are given in good faith and FG Smart Solutions will use every endeavour to comply therewith No responsibility can be accepted for any loss or damage incurred by the Customer on account of any delay in delivery arising out of any circumstances beyond “FG Smart Solutions” control, which circumstances will include, But in no way be limited to: Any delays in the supply of goods by FG frameless Glass’s Suppliers which cannot be directly or indirectly attributed to them; If the balance of the purchase price payable on delivery is not paid on date of anticipated delivery, FG Smart Solutions will communicate unavoidable delay in the delivery.
Warranty:
FG Smart Solutions warrants its customer that the goods which have been manufactured and/or supplied by the Company and delivered to the Customer shall be free from defects to the following: The warranty is effective for a period of five years on the FG03 Frameless Glass System, FG04 and FG02 when installed internally, and two years when FG02 and FG04 are installed externally. The date is determined from date of delivery and will entitle the customer to either request a refund; replacement or repair if goods are defective within such Period. Warranty on Polycarbonate strips one year only. FG Smart Solutions shall not be liable or responsible in any way for any damages of any nature whatsoever, including consequential and penal damages, caused by or due to any failure of operation or malfunction of the goods, unless such damages can be attributed to any circumstances reasonably within the control of FG Smart Solutions. The warranty shall immediately be rendered null and void in the event of any of the following: Any alterations or modifications or addition made to the goods supplied, without the prior consent of FG Smart Solutions. Failure to use goods in accordance with the instructions and specifications. General misuse and abuse of goods. Any damage caused by fire, flood civil disturbance or act of God. The client not having their original Tax Invoice available to be supplied to FG Smart Solutions in the event of a claim. The manufacturer is not given the opportunity to inspect the installed aluminium products in order to evaluate/determine the reason for the products malfunction, before the customer has requested the products replacement, repair or refund. The client chooses not to make use of FG installation team.
Indemnity:
The Client acknowledges the risk involved in the supply of the products by FG Frameless Glass and hereby indemnifies FG Smart Solutions against claims for harm/damage caused to the client / or their property due to unintentional act of any person, whether or not in the employ of FG Smart Solutions. This will include loss or damage caused as a result of fire or theft, or any economical lost pertaining to the harm/damage caused. This quote is subjected to final measurements on site. The quote will be adjusted should the sizes differ. The Promotional Material furthermore states: Special Feature: 8mm toughened glass with lifetime guarantee: Purpose: seven times stronger than normal glass; Special Feature: Double wool pile between glazing profile and tracks: Purpose: To make 99% weatherproof and eliminate wind noise.
Should any agreement be reached between a FG Smart Solutions representative / employee, and the client or any party representing the client, after the contract has been signed, such agreement will be declared null and void unless said agreement has been mailed or stipulated in writing, with the signature of both parties involed.
Please bear in mind that the following items are not standard and will be charged for if required:
- Additional cladding will be charged for.
- Waterproofing angles/aluminium lugs
- Waterproofing to be done by Specialists
- Cladding if the openings are not square.
- Aluminium and Steel uprights
- Steel and laminate beams
- Protective Peel on the glass
- Travel and Accommodation for areas 80+km outside of Cape Town
